Molte persone si sono mostrate interessate ad ottenere il Cd di NeoOffice®, in particolar modo gli utenti che hanno connessioni di tipo dial-up e quelli con connessioni a consumo. Contemporaneamente, altri hanno mostrato interesse per la distribuzione di NeoOffice® su CD.

In accordo ai termini espressi nella GNU General Public License (GPL), le copie dei binari di NeoOffice® possono essere venduti e distribuiti, avendo cura di includere o di offrire, come scritto nella licenza, anche il codice sorgente. Tuttavia, la GPL indica i termini della distribuzione solo riguardo al problema del copyright (diritto d'autore). Chiunque sia desideroso di vendere dei CD marchiati con la scritta NeoOffice® deve anche considerare il problema del Marchio.

NeoOffice®, come altri pacchetti di software open-source incluso AbiWord, il software Mozilla.org, e la distribuzione Red Hat Linux, hanno registrato il proprio nome. Le leggi sulla registrazione dei marchi è separata da quella del diritto d'autore. Laddove la legge sul diritto d'autore protegge i lavori creativi dall'essere distribuiti senza il permesso del detentore del diritto d'autore, le leggi sul marchio esistono per preservare i nomi dei marchi o i marchi grafici delle aziende, dei prodotti e dei servizi, tipicamente per prevenire che quei prodotti vengano contraffatti o duplicati all'interno di un certo mercato. La protezione dei marchi, per esempio, impedisce a chiunque all'infuori della Nike dall'utilizzare il suo famoso "fregio" su scarpe, o ad ogni altro produttore di bevande gassate di chiamare la sua bevanda "Pepsi" o a qualunque servizio musicale di chiamarsi "iTunes".

In maniera del tutto simile, il nome "NeoOffice®" è un marchio registrato (così come il carattere "®" dopo NeoOffice®) di proprietà di Edward H. Peterlin ed è protetto dalle leggi degli Stati Uniti d'America e dalle leggi internazionali sui marchi registrati.

Così, mentre la GPL permette a chiunque di copiare, modificare, ridistribuire ed anche vendere il codice sorgente ed i binari di NeoOffice®, le regole dei marchi registrati restringono il modo in cui il software può essere nominato e pubblicizzato al pubblico. Quindi, se volete rivendere software denominato NeoOffice®, dovete dovete aderire alla Linea Guida all'uso del Marchio NeoOffice® descritto sotto oppure dovete negoziare una licenza sul marchio separata.

Altrimenti, potete rivendere NeoOffice® (NeoOffice®/C ed il precedente NeoOffice®/J) senza negoziare una licenza sull'uso del marchio provvedendo a ricompilare autonomamente il codice sorgente e cancellando tutti i riferimenti alla parola NeoOffice® dal software.

Linea Guida all'uso del Marchio Registrato NeoOffice®

NeoOffice® è un marchio di proprietà di Edward H. Peterlin all'interno degli Stati Uniti d'America per qualsiasi merce che rientri nella Classe Internazionale 9, incluso, ma non limitato a, il software ed i prodotti per computer. Questo marchio sarà attivo fino al 2013 in base alla Section 8 del Trademark Act del 1946.

La GNU General Public License (GPL) non copre l'uso del marchio registrato, ma solo il diritto d'autore sul codice sorgente. Le regole dei marchi registrate sono regolate da altre leggi.

La Planamesa Software e Edward Peterlin intraprenderanno ogni azione legale necessaria ad assicurare che nessuno usi il marchio NeoOffice® in qualunque modo non conforme ai desideri proprietario. Qualunque uso del marchio NeoOffice® per software non direttamente affiliati al proprietario del marchio sono in tal modo proibiti.

This should also serve as notice that usage of the NeoOffice® trademark is hereby granted for any mirroring of only the NeoOffice® binaries that are currently available for download from Planamesa Software providing that you distribute such binaries to any and all individuals without charge. Personal or non-profit use of such binaries (e.g. burning CDs to hand out to family/friends, use for installs, handing out CDs at conferences, any non-profit activity or organization, etc.) is allowed by the usage policy.

The moment that an exchange of money is involved, usage of the NeoOffice® trademark is hereby prohibited unless 100% of gross margins on such sales are donated back to NeoOffice.org and Planamesa Software.

Definition of Gross Margins

"Gross margin" is the net profit minus cost of goods and services sold. For example, if it costs you $9 to make a CD and you give it away for free, your gross margin is -$9.

My usage of the term "gross margin" is explicit. I am not in any way trying to impinge upon any free usage of the trademark NeoOffice®, in the literal sense of free.

This includes any use of the trademark NeoOffice® in such a way that it does not directly relate to the sales of software e.g. listing on freshmeat, including CD inserts with magazines, giving away free CDs at conferences, giving away free CDs of any sort, etc.

CD Distributors

The following NeoOffice.org community members have volunteered to distribute NeoOffice® CDs in their respective regions of the world. Some may do so for free, some may do so at cost (cost of CD plus postage), and some may also require a small amount to be donated towards supporting the NeoOffice® effort.

How do I become a CD Distributor?

  • Your CD must contain items 1, 3, and 6 of this section
  1. The latest full binary release (e.g., NeoOffice 1.2 Alpha)
    • NeoOffice/J 1.1 should not be distributed any longer due to this bug
  2. The latest patch at time of burning (if you burn disk-per-person), as some patches can get large enough to be annoying to dialup users
  3. The NeoOffice source (ca. 1 MB .tar.gz archive) to satisfy GPL requirements
  4. Language Pack installer for your region, if applicable
  5. Localized help content installer(s) for your region, if applicable
  6. The Readme.rtf file from the official disk image (place this file at the root of your CD)
    You may modify or add additional information to the Readme.rtf file, but you must not replace any of the existing content of the file
